What to Do if I am Involved in a Car Wreck?
Car Wrecks Happen Every Day. What are the First Steps You Should Take?
According to the Mississippi Department of Public Safety, in 2015, there were 28,000 automobile accidents in Mississippi that resulted in serious injury. In 2016, there were 690 fatalities on Mississippi roads. Distracted driving (such as texting or talking while driving) and impaired driving (driving under the influence of alcohol or drugs) were major causes of traffic fatalities. If you are involved in a collision, it is vital to be knowledgeable beforehand. Below you will find our helpful hints on what to do, and what not to do when you or a loved one has gotten into an auto accident.
Never Drive Away From the Scene of a Car Wreck
Even an accident that does not cause major damage to your vehicle may cause damage and injury to others involved, so be sure to stay at the scene of the accident and follow the steps provided below.
Call the Police
Don’t ever hesitate to call the Police. Police Officers are equipped to respond to accidents on roads and highways at any given time. A police officer will gather all the necessary information from the parties involved and document the facts of the car accident by writing an accident report. By involving the police, you are creating an official record of what has happed on the scene which will better assist your legal team.
Gather Information
Gathering information for your own records is important. It is unlikely to know the next setting you will encounter other parties involved in an accident. To further help your legal team, gather contact and insurance information at the scene. Other information that should be gathered includes but is not limited to:
- Contact information for all parties involved in the car wreck (including third parties)
- Driver’s license and license plate numbers for all parties involved
- Names and contact information from any eye-witnesses on the scene
- List of businesses nearby the accident (if applicable)
- Pictures of the collision scene and/or vehicles involved
- Pictures of any injuries
Do Not Admit Fault
You should not admit fault on the scene of the accident. Even if circumstances cause you to think that you are at fault, it is ideal to wait until you speak with a lawyer.
Admitting fault could risk your ability to recover any damages relating to the accident. Often times, superseding causes that both parties are unaware of at the scene of the accident can play a large part in absolving you or the other driver of liability.
See a Doctor
If your physical injuries are severe, call 911 immediately for medical dispatch. If they are minor, be sure to indicate to the officer your physical pain and injury so it may be documented. Next, it is important to consult with your primary care doctor or emergency room doctor for treatment. Any injuries must be documented as a result of your wreck. The road to recovery may be short, but some cases require hospitalization, surgery, and multiple doctors’ visits over the course of months to years. Our car accident attorneys serving the State of Mississippi will protect your rights concerning these medical expenses. We will fight on your behalf, so you are compensated for all injuries, damages and expenses.
